Resumen
El tutor es el representante legal y administrador de los bienes del tutelado con la diligencia de un buen padre de familia. En el ejercicio de estas funciones y atendiendo al sistema de tutela de autoridad que se consagra en la reforma por Ley 13/1983, de 24 de octubre, la intervención judicial tiene lugar en calidad de órgano de control y se materializa a través de diversos instrumentos establecidos en el Código Civil, como la exigencia de autorización judicial para la realización de determinados actos o negocios contenidos en los artículos 271 a 273 del citado cuerpo legal, de los que nos ocuparemos en el presente estudio, y, que han de ser objeto de una interpretación restrictiva, y de cierta flexibilidad en su aplicación y alcance.
Abstract
A guardian is the legal representative of his or her ward and the duly diligent administrator of the ward’s estate. Courts, in their capacity as supervisory authorities, check on guardians’ performance of their functions, under the system of protection of authority laid down in the legislative reform enacted under Act 13/1983 of 24 October. Court supervision is embodied in a number of instruments established in the Civil Code, such as the requirement of court authorization in order to perform certain legal or other acts under articles 271 to 273 of the Civil Code. This paper deals with such instruments, which ought to be interpreted in a restrictive sense, with a certain amount of flexibility in their application and scope.
