Resumen
La Ley 41/2007, de 7 de diciembre, sobre Modernización del Mercado Hipotecario, ha modificado el artículo 12 LH, clarificando, por fin, qué cláusulas de la hipoteca deben inscribirse en el Registro. En este trabajo se hace un repaso a los criterios existentes hasta entonces y a las novedades que ha supuesto este artículo, tal y como lo han interpretado las últimas Resoluciones de la DGRN.
Abstract
Act 41/2007 of 7 December on the modernisation of the mortgage market amended article 12 of the Mortgage Act, clarifying at last which clauses of a mortgage must be registered. This paper reviews the criteria existing thitherto and the new features ensuing from the amendment of article 12, as interpreted by the latest decisions of the Directorate-General of Registries and Notarial Affairs.
