Resumen
Se analiza en este artículo el peculiar carácter constitutivo de la inscripción del derecho real de hipoteca frente al resto de los derechos reales que nacen con independencia de la inscripción registral. Se hace un breve repaso a los antecedentes legislativos de los preceptos que establecen la inscripción constitutiva y se estudia el fundamento y los efectos del carácter constitutivo de la inscripción de hipoteca.
Abstract
This article looks at the unique constitutive nature of registration in real rights of mortgage, in comparison with other real rights in whose creation registration plays no part. A brief overview is given of the legislative background of the precepts establishing constitutive registration, and a study is made of the foundation and the constitutive effects of mortgage registration.
