Resumen
La doctrina del Tribunal Europeo de Derechos Humanos protege los derechos habitacionales indirectamente a través de los derechos reconocidos en el Convenio Europeo de Derechos Humanos frente a la actuación de los poderes públicos en relación con el artículo 8, referido a la existencia de una vida familiar que se vería peligrar en el supuesto de la perdida de la vivienda familiar debido a la expulsión de la misma por las autoridades. Derechos habitacionales que también se protegen a través del derecho a un proceso equitativo, del artículo 6 del Convenio. Orden de desalojo del domicilio que puede producir una vulneración por tratos inhumanos y denigrantes, o, simplemente por carecer la vivienda de las características mínimas, afectando con ello a la dignidad humana por humillación y degradación sufridas vulnerándose el derecho a la no discriminación. Derechos y jurisprudencia del TEDH que pueden delimitar al derecho de propiedad.
Abstract
The doctrine of the European Court of Human Rights protects housing rights indirectly through the rights recognized in the European Convention on Human Rights against the actions of public powers in relation to article 8, referring to the existence of a family life that It would be endangered in the event of the loss of the family home due to its expulsion by the authorities. Housing rights that are also protected through the right to a fair trial, in Article 6 of the Convention. Order to evict the home that may cause a violation due to inhuman and degrading treatment, or simply because the home lacks the minimum characteristics, thereby affecting human dignity due to the humiliation and degradation suffered, violating the right to non-discrimination.
