Resumen
La reforma del Código civil operada por la Ley 8/2021, de 2 de junio, modifica sustancialmente el régimen de sociedad de gananciales en cuanto a la transferencia legal de la gestión de los bienes gananciales a uno solo de los cónyuges y la disolución judicial de la sociedad de gananciales (artículos 1387 y 1393, respectivamente). Estas modificaciones giran en torno a la figura de la curatela con facultades de representación plena, que es una de las medidas de apoyo que introduce la mencionada reforma en favor de las personas con discapacidad. El presente trabajo está destinado a la revisión y estudio de todos esos cambios que la Ley 8/2021 inserta en el régimen de sociedad de gananciales y que son propios del proceso de adaptación de las antiguas reglas al nuevo sistema de apoyos que implanta la Convención sobre los Derechos de las Personas con Discapacidad. Pero, antes de ello, se abordan algunos tópicos generales de la reforma para establecer la relación entre discapacidad, curatela y sociedad de gananciales.
Abstract
The Civil Code reform produced by Law 8/2021, of 2 June, substantially change the community property regime as regards the legal transfer to the management of community property to one of the spouses and the dissolution of the community of property (articles 1387 y 1393, respectively). These modifications are based on the figure of the curatorship with faculties of full representation, which is one of the support measures that introducing the said reform in favour of persons with disabilities. This work focuses on the review and study of all those changes that the Law 8/2021 inserts in the community of property and which are specific to the adaptation process of the old rules to new supports system introduced by the Convention on the Rights of Persons with Disabilities. But, prior to that, some general topics of the reform are addressed to establish the relationship between disability, curatorship and community of property.
