Resumen
La constancia registral de un exceso de cabida implica que se cumplan una serie de requisitos absolutamente necesarios para su práctica. Entre ellos es imprescindible que el Registrador no albergue ninguna duda acerca de la identidad de la finca sobre la que se practica el exceso de cabida. Analizamos en estas líneas el porqué de este requisito y qué hemos de entender por «dudas fundadas» del Registrador, a la hora de rechazar la inscripción del exceso de cabida, así como la especial naturaleza de esta operación.
Abstract
Registration of boundary corrections involves fulfilment of a series of requirements that are absolutely necessary in order for registration to occur.
Among other things, it is vital for the registrar to have no doubt whatsoever about the identity of the property whose boundary correction is being registered. We analyse why this requirement is set, what we should understand as «grounded doubt» when the registrar refuses to register a boundary correction and the special nature of this operation.
