Resumen
Obligación a plazo es aquella cuya eficacia, deber del deudor (deuda) y derecho del acreedor (crédito) viene determinada por un plazo a partir del cual (término inicial) o hasta el cual se produce (término final). La obligación a plazo del término de ejecución debe hacerse a la llegada del término, es decir, en la obligación a plazo, el término juega como tiempo de la obligación porque de ésta dependen sus efectos: como el deber del deudor y el derecho del acreedor, de la llegada del término. Por el contrario, el término de ejecución se refiere a la realización de la prestación que constituye el objeto de la obligación porque es el tiempo de la prestación o el tiempo de su cumplimiento.
Abstract
A time obligation is an obligation whose efficacy, the borrower's duty (debt) and the lender's right (credit), is determined by the time as of which (starting point) or until which (ending point) the obligation occurs. The time obligation must be enforced when the time has been completed; that is, in the time obligation, the point is the time of the obligation, because its effects depend on the obligation, just as the borrower's duty and the lender's right depend on the starting or ending point.
On the other hand, «enforcement» refers to the performance constituting the object of the obligation, because it is the time of performance or the time of discharge.
