Resumen
Este trabajo analiza, con una propuesta alternativa, la agónica «división judicial de la herencia», conformada, en la actualidad, por un trípode de procesos, voluntario el primero, destinado, en puridad, a alcanzar un acuerdo, concierto o anuencia de voluntades; especial y sumario, el segundo, una vez «transformado» al verbal, ante la discrepancia, conflicto o desacuerdo latente, tras aquel intento fallido de consenso, con sus respectivos recursos de apelación, casación e, incluso, amparo; y ordinario, al fin, el tercero, una vez agotadas sin éxito las instancias anteriores, con idéntica proyección de los recursos correspondientes.
Abstract
This work analyzes, with one alternative offer, agonizing «judicial division of the inheritance», shaped, at present, for a voluntary process tripod, the first, destined, in reality, to reaching an agreement, concert or compliance of wills; special and summary, the second one, once «transformed» to the verbal one, before the discrepancy, conflict or lack of agreement latent, after that unsuccessful attempt of consensus, with his respective resources of appeal, cassation and, even, I protect; and ordinary, to the end, the third party, once exhausted without success the previous instances, with identical projection of the corresponding resources.
