Resumen
En el ejercicio de sus amplios poderes de disposición, el testador puede liberar al sujeto pasivo del derecho de crédito del que es titular, renunciando a su pago. De modo tal que el acreedor y testador, en el momento de redactar la cláusula testamentaria, libera al legatario beneficiario de la deuda que contra él ostentaba. Por tanto, consecuencia directa es la renuncia a la exigibilidad del importe de la obligación adeudada. Caso de que el legado en cuestión no haya sido revocado y sea eficaz la manifestación testamentaria, el heredero gravado habrá de librar carta de pago si el beneficiario así lo exige. En este trabajo se analizarán las cuestiones controvertidas sobre dicho legado y sobre el supuesto en particular de pago de la legítima estricta mediante el legado de liberación previsto en el artículo 870 del Código Civil.
Abstract
In the exercise of the testator's broad powers of disposal, the testator may release a person owing the testator a debt by waiving payment of that debt. This may be done in such a way that the creditor/testator, when drawing up the provision, releases the beneficiary legatee of the debt. Therefore, one direct consequence is the waiver of the right to demand the sum owed. When the bequest in question has not been revoked and the will is valid, the encumbered heir will have to give a receipt if the beneficiary requires one. This paper will look at the controversial issues attached to such bequests and the particular case of payment of the reserved portion required by law by means of a bequest releasing the legatee from debt, provided for in article 870 of the Civil Code.
