Resumen
En estas líneas se estudia la consolidación de derechos inscritos como causa de cancelación registral. En concreto, se analiza la consolidación de derechos como causa de extinción de los derechos reales, y por lo tanto como presupuesto de cancelación registral. Se aborda el problema de si dicha cancelación es un supuesto de cancelación automática del artículo 82.2 LH, y si esto es compatible con la solicitud a instancia de parte de la misma. Por último se examina la forma adecuada en que debe practicarse dicha cancelación y cuál es el asiento que corresponde practicar para reflejarla.
Abstract
This paper is a study of the consolidation of registered rights as a cause of cancellation of registration. Specifically, it analyses the consolidation of rights as the cause of the annulment of real rights and therefore as grounds for cancellation of registration. The paper addresses the problem of whether such cancellation is a case of automatic cancellation under article 82.2 of the Mortgage Act and whether this is compatible with the request filed by an interested party. Lastly, the paper examines the correct way of performing such a cancellation and the proper sort of entry to be made to reflect the cancellation.
