Resumen
El posible impacto del alquiler vacacional sobre la convivencia vecinal, ha sido uno de los aspectos en los que se ha centrado el intenso debate que sobre la materia ha existido en España, y, debido a su importancia también ha sido uno de los aspectos que se ha tenido presente en el ámbito regulatorio. El objetivo de este trabajo es, por un lado, exponer la regulación y reformas que han tenido lugar con la finalidad de dar respuesta al fenómeno del alquiler vacacional y, por otro, analizar el alcance de la modificación operada por el Real Decreto Ley 7/2019, de 1 de marzo, de medidas urgentes en materia de vivienda y alquiler, respecto de la mayoría cualificada necesaria para que la comunidad de propietarios puedan limitar o condicionar el ejercicio de la actividad de explotación turística, y cuya regulación en términos análogos ya se contemplaba en el Código civil de Cataluña.
Abstract
The possible impact of vacation rental for the coexistence with neighbours, it has been one of the aspects that has focused on the intense debate which has existed in Spain and due to its importance it has also been one of the aspects that it has been taken into account in the regulatory field. The objective of this work is, on the one hand, to expose the regulation and reforms that have taken place with the proposal to respond to the phenomenon of vacation rental and, on the other, to analyze the scope of the modification operated by Royal Decree-Law 7/2019, regarding the qualified majority necessary to allow that owner’s community may restrict or condition the exercise of the tourism activity, and whose regulation with similar terms were already contemplated in the Civil Code of Catalonia.
