Resumen
La cláusula de vencimiento anticipado ha sido siempre una cláusula discutida en cuanto a su viabilidad, su validez y su inscripción en el Registro de la Propiedad. El hecho de que estas cláusulas den por vencido el préstamo a largo plazo, como es el hipotecario, con el perjuicio que ello supone para el deudor y la ventaja que supone para el acreedor, ha hecho que se consideren en determinados casos también como abusivas. Las últimas modificaciones legales, pero, sobre todo los vaivenes jurisprudenciales al respecto, merecen un estudio detallado sobre esta especial cláusula. Por eso, en este artículo pretendemos examinar qué son estas cláusulas, y cómo ha ido cambiando a lo largo del tiempo la percepción sobre las mismas, para el legislador, pero sobre todo para la jurisprudencia en torno a su admisibilidad, su inscripción y su abusividad.
Abstract
The acceleration clause has always been a clause discussed regarding its viability, its validity and its registration in the Property Registry. The fact that these clauses give up the long-term loan such as the mortgage, with the damage that this entails for the debtor and the advantage of the creditor has led them to be considered unfair clauses in many cases. The latest legal modifications, but above all the jurisprudential fluctuations in this regard deserve a detailed study on this special clause. In this paper we intend to examine what these clauses are, what are their consequences, and how the perception of them has changed over time, for the legislator, but especially for the jurisprudence about their admissibility, their registration and unfairness.
