LA ANOTACIÓN PREVENTIVA DEL RECURSO CONTENCIOSO ADMINISTRATIVO ENTABLADO CONTRA EL ACTO ADMINISTRATIVO DE INADMISIÓN A TRÁMITE DE LA SOLICITUD DE REVISIÓN DE OFICIO DE UNA LICENCIA POR LOS TRÁMITES DEL ARTÍCULO 102 DE LA LEY 30/1992. (ANÁLISIS DE SU IMPROCEDENCIA Y FACULTADES DEL REGISTRADOR PARA DENEGAR EL ASIENTO).

Resumen

Las anotaciones preventivas de recurso contencioso-administrativo que vienen previstas en el artículo 66 del Real Decreto 1093/1997 sólo son admisibles para los expresos supuestos que se prevén en dicho precepto. Cuando se recurre en vía contencioso-administrativa una decisión municipal por la que inadmite a trámite la petición de revisión de oficio de una licencia firme por los cauces del artículo 102 de la Ley 30/1992 de Procedimiento Administrativo Común, la sentencia que se dicte en dicho recurso solamente podrá obligar al Ayuntamiento a iniciar o no iniciar el expediente de revisión de oficio, sin poder resolver nada sobre la legalidad o nulidad de la licencia.
Siendo ello así, la sentencia que se dicte -aunque estime el recurso- nunca podrá afectar a la licencia ni, por tanto, producir una modificación de los libros del Registro de la Propiedad.
Si en ese recurso contenciosoadministrativo el Juzgado ordena la anotación preventiva del artículo 66 del Real Decreto 1093/1997, el Registrador de la Propiedad debe analizar si el procedimiento judicial donde se ordenó la medida cautelar puede acabar en una sentencia que anule la licencia o provoque algún tipo de modificación en las fincas o en los libros del Registro de la Propiedad, y si no es posible dicha modificación, tiene la competencia y el deber de denegar la anotación, precisamente por carecer de trascendencia jurídico real y registral, lo que se pueda decidir en la sentencia final, aunque sea estimatoria.

Abstract

Caveats warning of action under administrative law as provided for in article 66 of Royal Decree 1093 are admissible only in the express cases provided for in the said article. When an appeal is filed under administrative law against a municipal decision refusing to admit for processing a request for an ex officio revision of a final licence through the channels in article 102 of Act 30/1992 on common administrative procedure, the judgement handed down on said appeal can only force the city government to initiate or not to initiate the ex officio revision proceeding; it cannot decide anything about the legality or nullity of the license. This being so, the judgement handed down (even if it upholds the appeal) can never affect a license, nor therefore can it cause any modification in the property registration office's books. If in the appeal proceedings the court orders a caveat under article 66 of Royal Decree 1093/1997, the property registrar must consider whether the judicial procedure ordering the precautionary measure may end in a judgement annulling the license or cause any kind of modification in the properties or in the books of the property registration office; and if no such modification is possible, the registrar has the competence and the duty to refuse to enter the caveat, precisely because whatever may be decided in the final judgement, even if it upholds the appeal, has no real, registration-related legal significance.
