Resumen

 El matrimonio entre personas del mismo sexo ha sido incorporado a la legislación española; dejando de lado en este artículo la controversia que suscita, trae como consecuencia la determinación de la filiación de la descendencia de esas parejas. Tal extremo no ha quedado suficientemente aclarado y legalmente delimitado en nuestro Ordenamiento jurídico, lo cual ha suscitado polémica en cuanto a diferentes extremos relativos a ella. En este artículo nos hemos centrado en la adopción por estas parejas, su conveniencia y legalidad, tanto a nivel nacional como transfronterizo. Precisamente este último punto es el que suscita más problemas jurídicos y, al hilo de la Resolución mencionada en el título de este artículo y la Instrucción de 5 de octubre de 2010. Trataremos de dar una visión de cuál es la situación legal de las adopciones por parejas del mismo sexo.

Abstract

 Gay marriage is now incorporated to Spanish legislation; aside from its controversy, it brings the need to determine the filiations of their offspring. This point is not clear enough in our law and this brings different ground points of discussion. In this article we review the gay adoption issue: its necessity and legality, both in internal Spanish law and in international law. This last point is specially problematic from a legal point of view given the Decision that we mention in the title and the Instrucción de 5 de octubre de 2010. We will also try to give an overview of the legal situation of gay adoptions.
