Resumen
En la interpretación del testamento ha de buscarse siempre la voluntad del causante expresada en el testamento, considerándolo de forma global. La interpretación de los testamentos corresponde a los tribunales de instancia, siendo mantenida en casación ya que, de no hacerlo así, el recurso de casación se convertiría en una tercera instancia del pleito. El Supremo sólo debe pronunciarse cuando las soluciones dadas sean ilógicas, absurdas o contrarias a la voluntad del testador expresada en el testamento.
Abstract
In the interpretation of a will, the point to seek is the decedent's wishes as stated in the will considered as a whole. Interpreting wills is the task of trial courts and is to be maintained upon appeal to a higher court. Otherwise the appeal would become a third instance of the suit. The Supreme Court must only rule when the solutions given are illogical, absurd or contrary to the testator's wishes as stated in the will.
