Se produce la infracción por acto dispositivo del causante a través de una simulación de compraventa civil, siendo esto una cuestión de hecho que debe ser apreciada por los juzgadores de instancia y que se revela por pruebas indiciarias.

Critical analysis of case-law on legitime intangibility. Violation occurs through an act of disposal by the testator, via simulation of a civil sale.
This is a de facto question that must be evaluated by the courts of instance, and it is revealed by circumstantial evidence.
