Resumen
El seguimiento informativo de la vida privada de un conocido torero, con revelación de datos sobre su reciente separación, nuevas relaciones sentimentales y las circunstancias que rodearon a la muerte de su madre, también persona de reconocida notoriedad pública, no cabe hablar de intromisión ilegítima en su intimidad, ya que con su comportamiento decidió despojar del carácter privado lo atinente a su vida sentimental, si no de modo absoluto, sí al menos en lo referente a su separación matrimonial y nueva relación sentimental, que es el contexto en donde tienen encaje esencialmente las informaciones controvertidas. Tampoco cabe hablar de ilegitimidad de la intromisión en la intimidad del demandante en relación con las informaciones sobre su madre, puesto que era una persona famosa, habitual de los medios de comunicación de la llamada «prensa rosa», y que voluntariamente había limitado extremadamente su esfera de privacidad.
Abstract
News coverage of the private life of a well-known bullfighter, revealing particulars about his recent separation, new romance and the circumstances surrounding the death of his mother, also a person of acknowledged public renown, cannot be regarded as an illegal invasion of privacy. With his behaviour, he wilfully negated the privacy of his love-life, if not completely, at least with regard to his separation and new romantic relationship, which is the essential context of the controversial stories. Nor may the reports on his mother be regarded as an illegal invasion of the plaintiff's privacy, because she was a famous person in her own right, a regular in what are called «celebrity gossip» magazines, and she had voluntarily reduced her own sphere of privacy greatly.
