Resumen
La problemática que plantea el tema de las reclamaciones e indemnizaciones entre cónyuges y ex cónyuges es una de las más apasionantes y polémicas que presenta, en la actualidad, en nuestro país, el Derecho de Familia. Será la doctrina jurisprudencial la que vaya perfilando este tema. La autora, especializada en los problemas del derecho de familia, aborda la cuestión abogando por la concesión de indemnizaciones entre esposos y ex esposos, cuando se ha producido un daño a uno de los consortes frente al otro. Poco a poco, aunque con ciertas reticencias y timidez, se va abriendo paso la idea de que también en el seno de la comunidad familiar se deben dar lugar a indemnizaciones, superando así un viejo prejuicio.
Abstract
One of the topics that is currently arousing the most passions and debate in Spanish family law is that of the problems posed by claims and indemnities amongst spouses or ex-spouses. It will be case-law that eventually firms up the guidelines. The author, a specialist in family law problems, tackles the question by advocating the awarding of indemnities amongst spouses and ex-spouses when there have been damages inflicted on one of the spouses vis-à-vis the other spouse. Although progress is being made a little reticently and shyly, the idea that indemnities can be claimed for what goes on in the family community as well is gaining ground bit by bit, thus overthrowing an old prejudice.
