Resumen
Asistimos en la actualidad a una creciente aparición de modalidades locativas que nos llevan de la tradicional máxima romanista res movilis res vilis a las figuras de renting o leasing operativo de gran importancia social, económica y jurídica que se muestran especialmente relevantes en el sector del equipamiento industrial, los contratos y los servicios.
En este trabajo pretendemos analizar el arrendamiento de bienes muebles cuya trascendencia contrasta con la falta de regulación jurídica de la materia, tanto desde el punto de vista legislativo como doctrinal y jurisprudencial.
Hemos examinado sus caracteres esenciales, sus aspectos registrales y su régimen jurídico analizando sus diferencias con otras figuras arrendaticias como el leasing financiero, renting o leasing operativo.
Abstract
More and more modes of rental are appearing nowadays, causing a shift in views from the traditional Roman maxim, Res movilis res vilis, to concepts of operational leasing that are accruing great social, economic and legal importance and proving themselves especially meaningful in the sector of industrial equipment, contracts and services.
In this paper we attempt to analyse the leasing of personal property. The importance of the chattel leasing business contrasts with the lack of legal regulation on the matter. From the legislative standpoint, the doctrinal standpoint and the standpoint of case law, we have examined the essential features of chattel leases, the registrationrelated aspects of chattel leases and the laws applying to chattel leases, analysing the differences between these and other kinds of leases, such as financial leases and operating leases.
