Resumen
Las RRDGRN de 1 de junio y 26 de septiembre de 2006, junto con la remisión a las Cortes de la Ley de Reforma del Mercado Hipotecario, abren la puerta a la admisión en nuestro ordenamiento de las hipotecas flotantes puras. Desde estas líneas se analizan esas Resoluciones y el cambio producido en la jurisprudencia registral al admitir las hipotecas flotantes puras, diferenciándolas de las semi-flotantes ya admitidas tradicionalmente por el Centro Directivo.
Abstract
The Directorate-General of Registries and Notarial Affairs' Decisions of 1 June and 26 September 2006, plus the submission of the Mortgage Market Reform Act to the Cortes, open the door to the admission of laws on pure floating mortgages in Spanish legislation.
This article analyses these decisions and the change that has happened in registration case-law with the admission of pure floating mortgages. It also discusses the difference between pure floating mortgages and the semi-floating mortgages already traditionally admitted by the Directorate-General.
