GASTOS Y MEJORAS COMO DETERMINANTES DE LA POSICIÓN JURÍDICA DEL ARRENDADOR Y ARRENDATARIO EN LA LEY DE ARRENDAMIENTOS RÚSTICOS.

Resumen

La Ley de Arrendamientos Rústicos regula en su Capítulo VI los gastos y mejoras determinando a quién corresponde el derecho o el deber de realizar obras de conservación o mejora en el predio rústico.
La regla general es que tanto el arrendador como el arrendatario están obligados a permitir la realización de las obras, reparaciones y mejoras que deba o pueda realizar la otra parte contratante, las cuales deberán realizarse en la época del año y en la forma que menos perturben, salvo que no puedan diferirse.
El arrendador está obligado a realizar las obras y reparaciones que sean necesarias para conservar la finca en estado de poder servir al aprovechamiento que se concertó en el contrato; también le corresponde realizar las obras, mejoras o inversiones que por disposición legal o resolución judicial o administrativa firme hayan de realizarse sobre la finca arrendada.
Por otro lado, corresponde al arrendatario efectuar las reparaciones, mejoras e inversiones que sean propias del empresario agrario, presumiéndose que las mejoras hechas durante el arrendamiento han sido efectuadas a su cargo.

Abstract

Chapter VI of the Rural Lease Act regulates expenses and improvements, stating who has the right or duty to have improvement and upkeep work done on rural property.
The general rule is that both the landlord and the tenant are obligated to permit any construction, repair and improvement work that the other party to the lease must or may do, and such work must be done at the time of the year and in the fashion that cause the least disturbance, unless the work cannot be delayed.
The landlord is obligated to do any construction or repairs needed to keep the property in the proper condition so that it can be used for the purpose stated in the lease. The landlord also has the duty to perform any construction work or improvements or make any investments that are required by law or by a final judgment or administrative decision.
The tenant, on the other hand, has got to make any repairs, improvements or investments characteristic of the owner of an agricultural concern, and it is presumed that the improvements made during the lease have been done at the tenant's expense.
