EL TÍTULO SUPLETORIO EN EL ORDENAMIENTO REGISTRAL DE NICARAGUA.

Resumen
En este trabajo los autores analizan la figura del título supletorio en Nicaragua.
Por tal se entiende la autorización judicial para inscribir en el Registro de la Propiedad al interesado que acredite la propiedad (no la posesión) sin existir oposición de terceros.
Es un expediente ante el juez que insta el propietario que carece de título o bien que tiene un título que no se puede inscribir por adolecer de defectos insubsanables.
A través del título supletorio se facilita el acceso de las fincas al Registro y la lucha contra la clandestinidad.
Los autores, sin embargo, critican el abuso que se está haciendo en Nicaragua de esta figura, utilizada fraudulentamente, que produce el efecto contrario al pretendido y propugnan su abolición en el futuro.
Abstract
In this paper the authors analyse the concept of the supplementary title in Nicaragua. A supplementary title is a court's authorisation to have property registered as belonging to a person who shows proof of ownership (not possession) where there is no third-party opposition.
It is a proceeding carried out before a judge, filed by a property owner who has no title or whose title cannot be registered because of irremediable flaws.
Supplementary titles facilitate access to registration for property and the fight against clandestine transactions. The authors, however, criticise how in Nicaragua supplementary titles are being abused and used fraudulently to produce the opposite of the intended effect, and they advocate the future abolition of supplementary titles.
