Resumen
El trabajo hace una somera exposición de las normas de creación del Registro Mercantil Central y de su régimen jurídico. Se detiene en la aplicabilidad al Registro Mercantil Central del principio de legitimación registral. Analiza, asimismo, la Sección de denominaciones, contemplándola como un verdadero Registro y no como una mera base de datos y expone los criterios que rigen la calificación del registrador mercantil central en materia de denominaciones. Por último, analiza las relaciones entre el Registro Mercantil Central y otros Registros, como los Mercantiles Territoriales, los de Marcas, Fundaciones, Asociaciones o Cooperativas, así como los de denominaciones de origen.
Abstract
The study gives a brief exposition of the legislation creating the Central Commercial Register and the regulations that govern it. It looks at the applicability of the principle of ascribing legitimacy of registration to the Central Mercantile Register. It also analyses the Names Section, considering it to be a true Register and not a mere database and sets out the criteria that govern the central commercial registrar’s assessment of names. Finally, it analyses the relations between the Central Commercial Register and other Registers, such as the Provincial Commercial Registers, Registers of Trademarks, Foundations, Associations or Cooperatives, as well as registers of designations of origin.
