Resumen
Frente al carácter tasado y la interpretación restrictiva de las causas de desheredación de los hijos y descendientes contenidos en el artículo
853 del Código Civil, se aboga por una interpretación flexible adaptada a la realidad social actual y al máximo respeto a la dignidad de la persona del causante, posibilitando con ello que se incluya el maltrato psicológico enten- dido como falta de atención y menosprecio dentro de la causal del maltrato de obra, superando el aspecto físico. En esta línea, opera la sentencia del Tribunal Supremo de 4 de junio de 2014. Sobre la desheredación de los hijos y descendientes y esta novedosa orientación jurisprudencial se va a centrar el presente estudio.
Abstract
Opposite to the appraised character and the restrictive interpreta- tion of the reasons of disinheritance of the sons and descendants contained in the article 853 of the civil code, it is chosen for a interpretation adapted to the social current reality and to the maximum respect to the dignity of the person, making possible with it that includes the psychological mistreatment understood as lack of attention and contempt, inside the reason of the mistreatment of work, overcoming the physical aspect. In this line it produces the judgment of The Supreme Court of June 3, 2014. On the disinheritance of sons and descendants and this new juris- prudencial orientation, it’s going to centre the present study.
