Resumen
El presente trabajo analiza la jurisprudencia del Tribunal Supremo en relación con el interés superior del menor. este principio ha llegado a perfilar distintos criterios interpretativos. La dificultad está en que el menor es titular de derechos y el interés se presenta como principio rector que abarca distintas situaciones familiares que los entes públicos o privados, órganos administrativos y Tribunales han de concretar ante el conflicto de prevalencia del interés del menor.
Abstract
This work develops the jurisprudence of the Supreme Court in relation to the lower interest. This principle has come to outline different interpretative criteria. The difficulty is that the child is the holder of rights and the interest is presented as a guiding principle that covers different family situations that public or private entities, administrative bodies and tribunals have to realize before the conflict of prevalence of the child’s interest.
