Resumen
En este trabajo analizamos el incumplimiento esencial como categoría diferenciada del incumplimiento con carácter resolutorio tanto desde el punto de vista conceptual como desde su régimen jurídico. Dicha categoría se encuentra presente en el Derecho Contractual europeo y encuentra su base en la STS de 18 de noviembre de 2013 la cual ofrece una perspectiva novedosa del incumplimiento esencial centrándolo en la satisfacción del acreedor indagando en la causa concreta o base del negocio y aplicando criterios diferentes a los tradicionales de los incumplimientos prestacionales restitutorios basados en la gravedad del incumplimiento y el carácter principal de la prestación, dicho planteamiento tiene continuación en la STS de 29 de enero de 2014.
Abstract
In this paper I will try to analyze the essential default as a separate category of resolution default both from the conceptual point of view and from their legal system. This category is present in European contract law and is based on the STS of 18 November 2013 which provides a new perspective of essential default focus on the creditor satisfaction inquiring into the specific cause or negotio base and applying different criterions to the traditional resolutions defaults based on the main character of the provision, this question has continued on STS 29 January 2014.
