Resumen
La insolvencia patrimonial de una persona que persiste tras su fallecimiento puede desencadenar el fenómeno de la quiebra post mortem, donde confluyen derecho sucesorio y derecho concursal. El objeto de este trabajo es el de examinar la proyección de esta figura en el ordenamiento italiano de quiebras a través del estudio de las principales reglas que la disciplinan: presupuestos, plazos, legitimación, efectos... Todo ello permitirá no sólo realizar las oportunas comparaciones con la correspondiente regulación española de esta materia sino, y sobre todo, reflexionar en torno a la autonomía del patrimonio hereditario y a su separación.
Abstract
Financial insolvency that persists after a person's death may unleash the phenomenon of post-mortem bankruptcy, where succession law and bankruptcy law mingle. The object of this paper is to examine the influence of post-mortem bankruptcy on Italian bankruptcy legislation through a study of the principal rules concerning the topic, including budgets, time periods, legal standing and effects. The appropriate comparisons with Spanish rules and regulations are then drawn, and, more importantly, some reflections are offered on the autonomy of the hereditary estate and its separation.
