Resumen
Se pretende analizar los supuestos de desistimiento, no renovación o abandono de la vivienda arrendada por el arrendatario que dan lugar al derecho de subrogación a favor de su cónyuge o pareja convivente, así como el derecho de uso sobre la misma en caso de nulidad, separación o divorcio del arrendatario, en base a los artículos 12 y 15 LAU como manifestaciones de protección de la vivienda familiar.
Abstract
The object is to analyse those events where abandonment, failure to renew and desertion of a home leased by a lessee give rise to a subrogation right for the lessee's spouse or live-in partner, likewise the right to use the home in the case of annulment, separation or divorce from the lessee, on the basis of articles 12 and 15 of the Urban Lease Act, as manifestations of protection of the family home.
