Resumen
La presente investigación tiene como objeto analizar el nuevo Código Civil argentino, el cual contiene novedades de gran importancia en el ámbito de los Derechos Reales. Se observa una ampliación en su objeto, en las categorías (sobre cosa propia o sobre cosa ajena) y en su contenido. Puntualmente en materia de tiempo compartido, se supera la reglamentación impuesta por la normativa especial que primeramente lo reguló. Se presenta ahora como un sistema ordenado de protección estandarizada de los titulares, quienes contarán con la oponibilidad propia de los derechos reales. Los emprendedores gozan de garantías para encarar los desarrollos, limitados por los principios de buena fe y debida diligencia.
Abstract
This research aims to analyze the new Civil Code for Argentina, which contains new developments of great importance in the field of Real Rights. An expansion in its object, in the categories (on own thing or another's) and its content is observed. Specifically regarding timeshare, the original regulation that addressed the institution has been improved. It is now presented as an ordered system of standardized holders, who will have the very enforceability of property rights protection. Entrepreneurs enjoy guarantees to address the developments, limited by the principles of good faith and due diligence.
