Resumen
A lo largo del presente estudio vemos que la pignoración de dinero, si se confunde en el patrimonio del acreedor no es jurídicamente posible, pero sí lo es la del crédito que se ostenta para la restitución del tantundem, además si el deudor a su vez es acreedor pignoraticio de aquél recayendo su garantía sobre el crédito a la restitución, cabe la compensación sin que el pacto que la establezca incida en la prohibición del artículo 1.859 del Código Civil.
Abstract
In this study we see that the pledging of money is not legally possible if the money is mixed into the creditor's body of assets, but the pledging of credit held against the return of a «tantundem» is legally possible. In addition, if the borrower is in turn the secured creditor of the first creditor and the credit held against return is what secures his credit, offsetting is a possibility, and the offsetting agreement will not be prohibited under article 1859 of the Civil Code.
