Resumen
En aplicación del principio del «favor filii», el órgano judicial debe acordar las medidas más beneficiosas para los hijos y ante la publicación por el padre de fotografías del menor en Facebook, se resuelve a favor de la necesidad de consentimiento previo de la madre, o, en caso de oponerse, autorización judicial, pues la disposición de la imagen de un menor requiere el consentimiento de los que ostentan su representación legal, que son ambos progenitores, en cuanto titulares de la patria potestad.
Abstract
Applying the principle of «favor filii», the court must agree the most beneficial measures for children and before the publication of children photographs in the Facebook by the father (one of the parents), is resolved in favor of the need for the mother (other parent) previous informed consent or, in case of consent refusing, judicial authorization, because the image of a minor use requires the consent of those who hold legal representation, which are both parents, as holders of parental authority.
