EL ALCANCE DE LA REPRESENTACIÓN LEGAL DE LOS PADRES ANTE LAS ACTUACIONES ILÍCITAS DE SUS HIJOS MENORES DE EDAD.

Resumen
Los padres, como representantes legales de sus hijos menores de edad, responden ante las actuaciones ilícitas civiles y penales de estos, con independencia de su edad, del reconocimiento de cierto ámbito de autonomía y de una capacidad de obrar progresiva -más amplia cuanto más se acerca a la mayoría de edad- no exenta de control paterno. Sobre tales bases, el presente estudio se va a centrar en el análisis del alcance de la responsabilidad paterna ante los actos ilícitos civiles realizados por sus hijos menores de edad, sugiriendo la necesidad de una adaptación de tal responsabilidad a la nueva realidad social en la que el legislador estatal y autonómico va dotando de una mayor autonomía de actuación a los menores, sin acompañarlo de una flexibilización en la responsabilidad de los padres, sino al contrario se tiende a objetivizarla.
Abstract
The parents like legal representatives of his children minors answer before the illicit civil and penal actions of these, with independence of his age, of the recognition of certain area of autonomy and of an aptitude to act progressive - more wide when more it approaches the majority of age - it does not exempt of paternal control. On such bases the present study is going to centre on the analysis of the scope of the paternal responsibility before the illicit acts civilians realized by his children minors, suggesting the need of an adjustment of such a responsibility to the new social reality in which the state and autonomous legislator is providing with a major autonomy of action the minors, without accompanying it of a minor flexibility in the responsibility of the parents, but on the contrary it is stretched to make her severer.
