Resumen
La interpretación del artículo 98 de la Ley 24/2001, de 27 de diciembre, de Medidas Fiscales, Administrativas y del Orden Social y su coordinación con el artículo 18 LH, ha generado una discusión en torno al ámbito de la calificación registral, en cuanto a los poderes de representación. En estas líneas se hace un breve repaso a la jurisprudencia existente sobre el tema, recogiendo las sentencias más actuales de las Audiencias Provinciales resolviendo en recursos contra las Resoluciones de la DGRN, para tratar de exponer y resumir las posturas de sobra conocidas en torno a este asunto, y cuál es nuestro criterio sobre el mismo.
Abstract
Interpretation of section 98 of Act 24/2001 of 27 December on fiscal and administrative measures and measures of a social nature and its coordination with section 18 of the Mortgage Act has aroused discussion about the scope of a registrar's scrutiny of a representative's powers for due form. The existing case law on the subject is briefly reviewed, focusing on the most up-todate rulings of provincial appellate courts on appeals against decisions by the Directorate-General of Registries and Notarial Affairs, to try and explore and summarise the very well-known postures toward this affair and our own views on the matter.
