Resumen
La Ley 15/2015, de 2 de julio, de la Jurisdicción Voluntaria, dedica el Capítulo I de su Título I a las «Normas de Derecho Internacional Privado», y dentro de él se contiene en los artículos 11 y 12 la regulación de los efectos generales y registrales en España de los expedientes y actos de jurisdicción voluntaria acordados por autoridades extranjeras. Se trata seguramente de los artículos más oscuros y de difícil inteligencia de toda la Ley 15/2015. Pocas veces las críticas de la doctrina han sido tan rápidas, contundentes y unánimes como en este caso. Del entramado normativo formado por los artículos 11 y 12 de la Ley de Jurisdicción Voluntaria (en conjunción con los artículos 41 a 46 de la Ley de Cooperación Jurídica Internacional en materia civil, con los que presentan una directa conexión), se ha llegado a decir que es «terminológica y conceptualmente confuso, asistemático y falto de la mínima coherencia». Para intentar hacer una correcta exégesis de estos complejos y confusos preceptos es preciso empezar por realizar algunas aclaraciones terminológicas, conceptuales y de delimitación del sistema de fuentes normativas en esta materia. A esta tarea se consagra este artículo que estudia, además, los principios generales en materia de eficacia registral en España de las citadas resoluciones judiciales extranjeras en materia de jurisdicción voluntaria, el ámbito de aplicación objetivo y subjetivo de los citados artículos 11 y 12, el régimen de reconocimiento resultante de los mismos incluyendo el estudio de los motivos de denegación a que queda sujeto, y finalmente su régimen de calificación registral.
Abstract
Act 15/2015 of 2 July on voluntary jurisdiction devotes chapter I of title I to «Rules of Private International Law». Articles 11 and 12 of the chapter regulate the general effects and registration-related effects in Spain of proceedings and acts of voluntary jurisdiction on the part of foreign authorities. These are probably the most obscure, hard-to-read articles in the entire act. Rarely has criticism of the law fallen so quickly, roundly and unanimously as in this case. It has been said that the legislative snarl formed by articles II and 12 of the Voluntary Jurisdiction Act (in conjunction with articles 41 to 46 of the Act on international judicial cooperation in civil matters, with which they are directly connected) is «terminologically and conceptually muddled, without method and lacking in a minimum of consistency». To try and make a correct exegesis of these complex, confusing rules, one must begin by clarifying certain terms, concepts and delimitations of the system with strong legislation in this matter. This paper undertakes this task and moreover examines general principles on the enforceability of foreign judgements in matters of voluntary jurisdiction as regards registration in Spain, the objective and subjective realms of application of articles 11 and 12, the system of acknowledgement resulting from the articles (including a study of the grounds for refusal to which the system is subject) and, lastly, the procedure for scrutiny by registration officials.
