Resumen
Este trabajo aborda el estudio de los efectos de la fianza en la relación del fiador con el acreedor. Cuando el acreedor se dirige al deudor para el cumplimiento de la obligación principal y el deudor la incumple, el acreedor ha de dirigirse al fiador para que cumpla por el deudor, ante esta reclamación, el fiador tiene, por una parte, el beneficio de excusión, de forma que puede eludir el cumplimiento de la obligación hasta que el acreedor no haya perseguido los bienes del deudor que el fiador ha designado; y, por otra, tiene el beneficio de división, en caso de cofianza, por el cual el fiador puede dividir el pago de la deuda cuando el acreedor le reclama la totalidad de la misma o una cantidad mayor de la que le corresponde. Se analizan, de uno y otro beneficio, los antecedentes, los conceptos, los requisitos para su ejercicio, las causas por las que no tienen lugar, así como sus efectos.
Abstract
This work analyses the legal effects of the guarantee and the relation between guarantor and creditor. When the creditor requires the debtor to comply with a existing legal obligation and the debtor fails, the creditor alternatively addresses the guarantor to comply with the debt obligations. Upon request, the guarantor can firstly invoke the right to object, through delaying or preventing the fulfillment of payment until the creditor has compensated debts from the debtor’s assets designated by the guarantor; on the other hand, the guarantor can oppose the benefit of división in cases of joint guarantee, whereby the guarantor can split the payment due when the creditor claims the full debt or a greater amount than it is entitled to. Backgrounds, main concepts, legal requirements, exception clauses and legal effects are analysed here in detail.
