Resumen
El arbitraje, como sistema de resolución alternativa de controversias, está basado en la confianza de los que a él acuden. Para conseguir esa confianza es imprescindible que el proceso de designación de los árbitros respete el principio de igualdad de las partes. Los árbitros serán nombrados con sujeción a lo previsto por los que se someten al arbitraje, a lo establecido en el reglamento de la institución arbitral y, cuando ello no sea posible, a través del procedimiento judicial previsto en la Ley. También están legalmente previstos los mecanismos para garantizar la independencia e imparcialidad de los árbitros. Los registradores y notarios pueden actuar como árbitros, pero, dadas las diferencias en su régimen de actuación profesional, los requisitos de independencia e imparcialidad se verán mucho más comprometidos en el caso de los notarios.
Abstract
Arbitration, as alternative dispute resolution systems, is based on the parties´trust. In order to achieve this trust, it is essential to respect the principle of equality of the parties at the process of appointment of the arbitra- tion. Arbitrators shall be appointed subject to the provisions of the parties, to the provisions of the regulations of the arbitration institution and, when this is not possible, through the judicial procedure provided for in the Law. Moreover, there are some other legal mechanisms to guarantee the independence and impartiality of the arbitrators. Lan registrars and notaries are legally allowed to act as arbitrators, but, due to their professional performance regime, independence and impartiality are much more compromised in the case of the notaries.
