Resumen
El nacionalismo cultural sostiene que los bienes culturales han de ser devueltos al Estado de cuyo territorio han sido ilegalmente trasladados. Cuando tal Estado ejercita una acción contra el poseedor de tales bienes culturales, los tribunales competentes, para conocer de la misma, no suelen aplicar normas extranjeras de protección del patrimonio cultural.
Sin embargo, la Directiva 93/7/CEE establece en su artículo 12 que la propiedad de los bienes culturales se regirá por la legislación del Estado requirente.
Abstract
Cultural nationalism maintains that cultural objects must be returned to the State from whose territory they have been unlawfully removed. When that State initiates proceedings against the possessor of those cultural objects, the competent courts usually do not enforce foreign rules on the protection of national treasures.
However, the Council Directive 93/7/EEC states in article 12 that ownership of cultural objects shall be governed by the law of the requesting Member State.
