Resumen
Se ha repasado la doctrina jurisprudencial de los últimos años, relativa a todas las cuestiones cercanas a la emancipación, cuya esencia se basa en la atribución a un menor, por parte de sus padres o tutores, de la mayor parte de sus derechos y facultades civiles, esto es, anticipar en pocos años la extinción de la patria potestad. No obstante la importancia de la figura se encuentra muy devaluada, utilizándose primordialmente como criterio diferenciador en las crisis matrimoniales de los padres a los efectos de otorgar la pensión alimenticia o el derecho de alimentos entre parientes. Sin olvidarnos de los supuestos donde es utilizada para poner fin a situaciones familiares difíciles.
Abstract
The jurisprudential doctrine of recent years concerning all the issues closely concerning emancipation is reviewed. The essence of emancipation is the assignment to a minor by his or her parents or guardians of most of the minor's civil faculties and rights, i.e., the advancement by a few years of the termination of patria potestas. Nevertheless, the importance of the concept is quite devalued. Emancipation is primarily used as a differentiating criterion in parental marital crises, for the purpose of assigning maintenance obligations or the right thereto among relatives. There are also cases where emancipation is used to put an end to difficult family situations.
