Resumen
El Tribunal Supremo afirma que la normativa española referida a la incapacidad jurídica se ajusta a la Convención de Nueva York, al contar con los instrumentos jurídicos propios de la tutela, la curatela y el patrimonio especialmente protegido. Sin embargo creemos que la Convención abandona ya estos viejos instrumentos en orden a la atención de las personas discapacitadas, y los sustituye por un sistema de apoyos puntuales de carácter, extensión e intensidad variados. Es cierto que la curatela cumple la función que podría asignarse a la instauración de apoyos puntuales, máxime cuando la normativa española aún no se ha adaptado a las directrices y principios de la Convención de Nueva York. Sin embargo, no nos parece correcto mantener instituciones propias de la incapacitación judicial que chocan abiertamente con los mandatos de la Convención.
Abstract
The Supreme Court of Spain states that the Spanish regulation referred to legal incapacity can be applied and interpreted according to NY Convention, given that it have proper legal instruments of guardianship, curatorship and specially protected heritage. However, we believe that the NY Convention has left these old instruments of care for the disabled and has replaced them by a system of targeted support that can differ in their character, extent and intensity. It is true that curatorship has the function that could be allocated to the implementation of specific support, especially when the Spanish legislation has not yet been adapted to the guidelines and principles of the NY. Convention. However, it does not seem correct to maintain judicial incapacitation own institutions openly clash with the mandates of the Convention.
