¿Puede constituirse una hipoteca en garantía de fianza, que asegura, a su vez, un crédito hipotecario? Según se considere que la fianza es una relación jurídica independiente de aquélla que garantiza, o se crea que se trata de la misma obligación, las respuestas serán distintas.
Abstract
Can a mortgage be made to guarantee a bond that is in turn used as collateral for mortgage credit? Depending on whether the bond is considered to be a legal relationship independent of the relationship it secures or whether it is believed to be part and parcel of the same obligation, the answers will differ.
