Resumen
De nuevo la Justicia europea analiza una de las cláusulas financieras que ha generado gran controversia en el ámbito de los contratos de préstamo hipotecario. Con la STJUE de 3 de marzo de 2020 (asunto Gómez del Moral Guasch, C-125/18) se resuelven varias cuestiones prejudiciales planteadas desde un juzgado español en relación con la posible abusividad de la cláusula de interés variable atendiendo a un índice de referencia IRPH. En este trabajo se analizan la naturaleza y características de esta cláusula y dicho índice de referencia, la previa STS de 14 de diciembre de 2017 (de Pleno) que abordó esta cláusula sentando doctrina, no unánime en cuanto se acompañó de un voto particular discrepante de dos magistrados, y, por último, los fundamentos de esta reciente STJUE de 3 de marzo de 2020.
Abstract
Once again the European Justice analyzes one of the financial clauses that has generated great controversy in the field of mortgage loan contracts. With the STJUE of March 3, 2020 (Gómez del Moral Guasch case, C-125/18) several preliminary questions raised by a Spanish Court in relation to the possible abusiveness of the variable interest clause based on a reference index are resolved IRPH. This work analyzes the nature and characteristics of this clause and said reference index, the previous STS of December 14, 2017 (plenary) that analyzed this clause establishing doctrine, not unanimous as it was accompanied by a dissenting individual vote of two Magistrates, and, finally, the legal grounds of this recent STJUE of March 3, 2020.
