Resumen
La atribución del uso de la vivienda familiar, es una forma de protección a favor de los hijos, que se aplica con independencia del régimen de bienes del matrimonio o de la forma de titularidad acordada entre quienes son sus propietarios, por lo que no puede limitarse el derecho de uso al tiempo durante el cual los progenitores ostenten la titularidad sobre dicho bien.
Abstract
Use of the family home is assigned by the court as a way of protecting the children. The measure is applied regardless of the type of marital property system the couple had or the form of ownership to which the owners of the home have agreed. Therefore, the right to use the family home cannot be limited to the time during which the parents are the owners of the property.
