Resumen
La publicidad es la actividad en la que se nos presenta a los consumidores productos para que nos sintamos atraídos a su compra. En la actualidad forma parte de nuestra vida cotidiana y cada vez son más los medios por los que la recibimos. El problema aparece cuando la publicidad que se utiliza para persuadirnos traspasa los límites permitidos. Uno de estos límites es el engaño. Sin duda las prácticas publicitarias engañosas se producen con más frecuencia de la deseada. Son muchos los casos que llegan a los tribunales y al jurado de autocontrol. En el presente comentario analizamos cuándo estamos ante un supuesto de publicidad ilícita por engañosa, y cuáles son los medios que tiene el consumidor para combatirla cuando ha sido victima de la misma.
Abstract
Advertising is the activity in which we consumers are presented with products so that we will feel drawn to purchase them. Nowadays advertising forms part of our daily life, and we receive it over an increasing number of channels. The problem occurs when advertising crosses the limits on what it is allowed to do to persuade us. One of those limits is falseness in advertising. False advertising practices are certainly used more frequently than is desired. Many are the cases that reach the courts and the advertising industry's Self-Control Jury. This commentary analyses when advertising is illicit due to falseness and what means are available to consumers to combat false advertising that has successfully deceived them.
