Resumen
En relación a la Ley 41/2003, de 18 de noviembre reforma, podemos destacar algunas ideas. En primer lugar, hay que resaltar que permite alterar el tradicional principio de la intangibilidad de la legítima. En segundo lugar, hay que poner de manifiesto que, con esta reforma en concreto, el sujeto al que se pretende proteger no es aquel a quien, en principio, trata de tutelar toda la Ley (la persona con discapacidad), sino otro distinto que no tiene que coincidir con aquel: el incapacitado judicialmente. También es resaltable el que se trata de una reforma parcial del Derecho de sucesiones.
Abstract
In relation to Law 41/2003, of November 18 reform, we study some ideas. First of all, it should be noted that it allows us to alter the traditional principle of the intangibility of the legitimy. With this particular reform, the subject to whom it is intended to protect is not the one who, in principle, tries to protect the entire Law (the person with a disability), but a different one it does not have to coincide with that one: the legally incapacitated. It is also noteworthy that it is a partial reform of inheritance law.
