Resumen
Tanto la patria potestad prorrogada como la patria potestad rehabilitada van a desaparecer de nuestro ordenamiento jurídico a consecuencia de la aprobación y publicación del proyecto de Ley por la que se reforma la legislación civil y procesal para el apoyo a las personas con discapacidad en el ejercicio de su capacidad jurídica que adapta la Convención Internacional sobre Derechos de las Personas con Discapacidad y que supuso la consagración de un modelo diferente en el tratamiento jurídico de la discapacidad. Tras el análisis jurisprudencial de ambas figuras resulta conveniente los efectos de su desaparición.
Abstract
Both the extended parental authority and the rehabilitated parental authority will disappear from our legal system as a result of the approval and publication of the bill to reform civil and procedural legislation to support people with disabilities in the exercise of its legal capacity that adapts the International Convention on the Rights of Persons with Disabilities and that supposed the consecration of a different model in the legal treatment of disability. After the jurisprudential analysis of both figures, the effects of their disappearance are convenient.
