Resumen
Nuestro Código Civil común recoge ciertas atribuciones legales por causa de muerte y a título singular, que no se consideran legados al no proceder de la voluntad del testador, sino de la ley, atendida la construcción teórica de que los legados, necesariamente, deben proceder de dicha voluntad del causante. Así, entre otros, el derecho de reversión, es un buen ejemplo de atribución legal mortis causa, o más claramente aún, la legítima. Pues bien, en estos casos la doctrina suele hablar de atribuciones ex lege por causa de muerte e, incluso, de legados ex lege, sin apreciar que estos llamados legales son legados en sentido estricto. Por su parte, la jurisprudencia sobre la legítima no ha seguido una línea uniforme, calificándola como cuota de activo neto o bien como parte de herencia. El presente trabajo dilucidará si tales atribuciones legales mortis causa a título singular pueden ser o no legados.
Abstract
The Spanish Civil Code, have legal attributions by reason of death and to singular title are not considered legacies when not coming from the testator, and is of the law,. This way, among other, the reversion right, is a good example of attribution legal mortis it causes, or more clearly still, the legitimate one. In these cases the doctrine usually speaks of attributions former lege by reason of death and, even, of legacies former lege, without appreciating that these legal. The jurisprudence on the legitimate, it has not an uniform line, qualifying as quota of active or inheritance part. The present work will elucidate if this attributions legal mortis cause to singular title they can be or non legacies.
