Resumen
Edificios históricos, monumentos, jardines, parques, conjuntos y sitios históricos, en general, están expuestos a riesgos previsibles causados por catástrofes naturales, incendios, especulación, expolio, vandalismo, en general, actos antisociales varios, que pueden hacer que buena parte de nuestro rico Patrimonio Histórico Español6 se convierta, por ejemplo, en vertedero de basuras o sufra la agresión que provocan los grafitis sobre sus muros y paredes. Este deterioro viene sucediendo en los últimos años y evidencia la falta de cultura de Seguridad y Prevención que, lamentablemente, se da hoy en nuestra sociedad a pesar del aluvión de normas de carácter legal y reglamentario que existen. En este trabajo tendremos ocasión de constatar, a través de algunos ejemplos, que desde que fuera promulgada la Ley 16/1985 del Patrimonio Histórico Español, de 25 de junio, y el Reglamento 111/1986, de 10 de enero, que la desarrolla parcialmente en lo que a aspectos procesales y organizativos se refiere, las normas que les han seguido sobre prevención de daños causados por catástrofes naturales, incendios, especulación, expolio, vandalismo y, en general, actos antisociales varios, que inciden directa o indirectamente en la protección patrimonial, requieren de una refundición y reordenación que ponga fin al disperso marco normativo actualmente vigente. Este es, pues, el primer objetivo que nos hemos propuesto en este trabajo de investigación. La cultura de la Prevención aplicada a bienes que componen nuestro rico PHE requiere de esfuerzos interpretativos que vayan más allá de las meras exigencias legales. Nos guía el convencimiento de que, para el mantenimiento y conservación del PHE, las acciones de Seguridad y Prevención tienen más eficacia que las de carácter meramente reparador ya que, tal y como dice el refrán, «más vale prevenir que curar».
Abstract
Historic buildings, monuments, gardens, parks, complexes and historic sites in general are exposed to foreseeable risks. These risks, traceable to natural disasters, fires, speculation, spoliation, vandalism and sundry antisocial acts in general, could turn a good portion of Spain's rich historic heritage into a midden or a mere backdrop for graffiti. Things have become worse in recent years, and there is mounting evidence to show that today's society has a sad lack of any culture of security and prevention, despite a welter of laws and regulations. Since Spanish Act 16/1985 of 25 June on the Spanish historic heritage and Regulation 111/1986 of 10 January (the latter, in partial implementation of Act 16/1985 in points of procedure and organisation) were passed, they have been followed by rule after rule aimed at preventing damage by natural disasters, fires, speculation, spoliation, vandalism and sundry anti-social acts in general. These rules directly or indirectly influence the protection of the Spanish national heritage. This paper shows, through examples, that existing legislation is too unfocussed to be effective and therefore requires reorganisation and revision. Applying the culture of prevention to Spain's rich historic heritage calls for efforts in the way of interpretation that go beyond mere legal requirements. In order to maintain and preserve the Spanish national heritage, security and prevention are more effective than mere repair. As the saying goes, an ounce of prevention is worth a pound of cure.
