Resumen
El presente trabajo tiene como objetivo analizar la posible existencia de una relación jurídica necesaria entre la solución adoptada por un sistema jurídico para la separación de los planos real y obligacional del derecho y el sistema de registro de bienes inmuebles adoptado por el mismo sistema. También busca establecer la diferencia entre los sistemas de registro de inmuebles que protegen predominantemente la seguridad jurídica estática, donde existe el llamado registro de documentos, y los que tutelan la seguridad jurídica dinámica, los llamados registros de derechos, mostrando sus diferencias.
Abstract
The present work aims to analyze the possible existence of a necessary legal relationship between the solution adopted by a legal system for the separation of the property and contract plans of law and the real estate registration system adopted by the same legal system. It also seeks to establish the difference between the real estate registration systems that predominantly protect static legal security, where there is the so-called registration of deeds, and those that protect dynamic legal security, the so-called registration of title, showing their differences.
