Summary
La responsabilidad civil médica por wrongful birth es un caso paradigmático de evolución doctrinal y jurisprudencial de un ámbito de responsabilidad civil, desde su negación en los últimos años del siglo XX, hasta su total admisión y perfilamiento en la actualidad. Con todo, plantea problemas jurídicos muy complejos, que merecen revisión crítica. Esos problemas se corresponden con los distintos epígrafes en que se estructura el presente trabajo.
El objeto de este trabajo es analizar críticamente el actual estado jurisprudencial, tanto de la jurisdicción civil como de la contencioso administrativa, de este ámbito de la responsabilidad civil médica, y a la vez ofrecer un análisis crítico de cada uno de sus puntos problemáticos.
Abstract
The medical liability in wrongful birth actions, is a paradigmatic case of doctrinal and jurisprudencial evolution, from its denial in the end of S. XX to its admission nowadays. However, wrongful births actions involve hard legal questions, which should be analized critically. These questions are the basis of the structure of this paper.
The purpose of this paper is to study the current state of this matter in the legal practice and at the same time offer a critical analysis of each of its problematic points.
