Summary
En general, no cabe una atribución de uso indefinido de la vivienda familiar a un hijo con discapacidad, siendo que la misma no es refleja o automática por la existencia de una discapacidad, sino que debe existir una clara conexión entre la situación de discapacidad y la necesidad de mantener la vivienda como hogar familiar, de forma que la fijación del plazo del uso de la misma será directamente proporcional con la intensidad de la necesidad de la persona con necesidad de apoyo.
Abstract
In general, the indefinite use of the family home cannot be attributed to a child with a disability, since it is not reflexive or automatic due to the existence of a disability, but there must be a clear connection between the disability situation and the need to maintain the dwelling as a family home, so that the setting of the term of use of the same will be directly proportional to the intensity of the need of the person in need of support.
